The right to self-determination is the recognition of the ability to choose an independent and autonomous individual. Appears as an expression of feminist struggles over the years.
The women's movement coined to mean the right to choose with respect to issues of sexuality and reproduction. Claim total autonomy of the management of its body was a starting point, which leads to complaints, and partly solve the many forms of violence, coercion and discrimination suffered by the female gender for the wrong law of time and dynamics family subject to a patriarchal social structure. Originating from a need
Il principio di autodeterminazione dei popoli sancisce il diritto di un popolo sottoposto a dominazione foreign to gain independence, to join another state or at least be able to choose its own political system. This principle is a rule of general international law that a rule which has legal consequences (rights and obligations) for the entire community. Moreover, this principle is also a rule of jus cogens, that is non-derogable right (which means it is a supreme and inalienable principle of international law, it can not be waived by international convention). Like all international law, the right to self-determination has been ratified by domestic laws, such as Ln881/1977, it counts as state law prevails over domestic law (Cass.pen. 21-3 1975)
